Immunity

Ohio governmental entities are exempt from many areas of tort liability when engaged in a governmental function. There are a few recognized exceptions found in the Ohio Revised Code, Section 2744:

  • Streets & Roads - public roads must be kept in repair and free of obstructions.
  • Public Buildings - an obligation exists to maintain and repair grounds & buildings open to the public.
  • Motor Vehicles - an entity is liable for the negligent operation of a motor vehicle. However, they have full immunity while operating a vehicle on an emergency run.

Currently, ORC 2744 allows for a 2 year statute of limitations for claims to be brought against a political subdivision.

ORC 2744 provides for a doctrine of comparative negligence, wherein the assessment of liability is based on the degree of negligence. Collateral sources (the other party's insurance) are used as a deduction in the calculation of a judgment against a political subdivision or its employees.

Incident Reporting

Ohio Plan Representatives are provided with claim and incident reporting forms and are required to report incidences that may lead to a member having a loss. This allows the risk control and claiM departments to collect information while it is still fresh in the minds of witnesses. The incident reporting procedure gives the Ohio Plan flexibility in evaluating and/or minimizing a potential loss.

In the event of litigation covered under the plan, Hylant Administrative Services assigns an appropriate law firm to provide defense for the member. The following list includes, but is not limited to, firms which may provide defense for members.
